All use of this website, www.justicenet.ca, and of the related professional site at secure.justicenet.ca (together, the "website"), is subject to the following terms and conditions (the "Terms of Use"). If you do not agree with these terms and conditions, please do not access or use this website. These terms may be changed by JusticeNet at any time as described under Modifications to Terms of Use below. Your use of the website, including creating an account, submitting a registration, or contacting a Service Provider through the website, constitutes your agreement to be bound by these terms.
JusticeNet
JusticeNet is a Federal not-for-profit corporation with its seat in Toronto (hereafter "JusticeNet"). Its primary mission is to help people in need of legal expertise, whose income is too high to access legal aid and too low to afford standard legal fees. It aims to achieve this mission through the JusticeNet Access to Justice Program (hereafter "The JusticeNet Program", or simply "the Program"). The JusticeNet Program provides a framework for Canadian lawyers, paralegals, and mediators ("Service Providers") to offer their services to qualifying clients at reduced fees. The Program includes an on-line directory (the "Directory") and a call centre, both of which are intended to connect participating Service Providers with members of the public. The Program currently serves legal matters in Ontario. You do not have to live in Ontario to seek assistance with an Ontario matter; however, the Service Provider you contact must confirm whether they are able to assist with your circumstances and location. The Program's scope is limited to establishing the conditions for reducing the fee component of the solicitor-client relationship and client fee agreements, including client qualification and a reduction of the Service Provider's regular fee(s) for qualified clients. All other components of the solicitor-client relationship and any agreements between the client and the lawyer, paralegal or mediator shall fall outside the scope of the Program.
Eligibility and Accounts
The services provided on this website are offered to adults seeking assistance with a legal matter in Ontario, wherever they reside, and to lawyers, paralegals and mediators licensed to practise in Ontario. By using this website you represent that you are at least 18 years of age (or the age of majority in your province or territory) and that you are legally capable of entering into a binding agreement.
Certain features of the website, including client registration and the professional site, require you to create an account. You agree to provide true, accurate, current and complete information when registering, to keep that information up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account and must notify JusticeNet promptly at info@justicenet.ca if you become aware of any unauthorized use of your account. JusticeNet may suspend or close any account that it reasonably believes has been used in breach of these Terms of Use.
Client Eligibility Information
If you register as a prospective client, you may be asked to provide information about your personal net income and family household size in order to determine whether you are eligible for reduced fees under the Program. You agree that this information will be true and complete. JusticeNet does not verify eligibility; the Service Provider you contact is responsible for confirming your eligibility and may ask you for supporting documents. Eligibility for reduced fees does not mean that any particular Service Provider can act for you: each Service Provider must confirm whether they are able to assist with your circumstances and your location, including whether your matter falls within Ontario and within their area of practice. Providing false or misleading eligibility information may result in a Service Provider declining to act for you at reduced rates, amending your fee agreement, or withdrawing from your matter, and may result in the termination of your access to the website.

The Directory and materials provided on this site are for information purposes only. The Directory contains only information submitted by participating Service Providers which has NOT been independently verified for accuracy. JusticeNet does not represent or endorse any Service Provider appearing in the Directory, and inclusion in the Directory is not a certification of a Service Provider's competence, qualifications or standing. For further information about the qualifications of a particular Service Provider, you may contact the relevant governing associations and regulatory bodies – some helpful websites are listed on the Legal Associations page.
JusticeNet does not offer legal, paralegal or mediation services or legal advice, and is not a law firm or a lawyer referral service. If you require any of these services, you should retain competent legal counsel to advise you. If you would like to retain a Service Provider listed in the Directory on this website, please contact the selected Service Provider directly using the contact information provided for each participant on the list. JusticeNet is not responsible for, nor does it guarantee, the services or advice provided by any lawyers, paralegals or mediators retained through the use of this service, their availability to take on your matter, the fees they charge, or their compliance with all applicable ethical codes of conduct. JusticeNet does not guarantee that any Service Provider will agree to act for you. It is the Service Provider's responsibility to confirm whether they can assist with your circumstances and location, including whether your matter is one that can be dealt with in Ontario.

Automated Tools
Where available, automated search, rate-calculation, chat, voice-assistance and translation tools may help you navigate the website or understand the Program. Their answers, calculations and translations may be inaccurate, incomplete or out of date, and you should confirm important information with JusticeNet or the relevant Service Provider. A search match or the ordering of search results is not an endorsement of any Service Provider or a determination that they are suitable for your matter. Automated tools cannot accept a matter on behalf of a Service Provider or make a binding fee agreement on their behalf.
Confidentiality of Communications
JusticeNet does not guarantee the confidentiality of any communications sent by e-mail or through its website, or left in voicemail messages on its telephone system. Such information and material may not be treated as confidential, and will not be protected by any solicitor-client privilege. Please do not send JusticeNet, or leave with the call centre, any detailed or sensitive information about your legal matter.
Accessing or using this website does not create binding agreements between Service Providers and their clients. Although the use of the website may facilitate access to or communications with the Service Providers by e-mail or voicemail, the delivery of any such communications to any Service Provider identified on this website does not create a solicitor-client relationship (or any other agreements) until that Service Provider specifically agrees to act for you on a matter. Until they specifically agree to do so, you should not provide them with confidential information or material.
By using the website you consent to receive communications from JusticeNet electronically, including by e-mail to the address associated with your account, and you agree that such communications satisfy any legal requirement that a communication be in writing.
Acceptable Use
You agree to use this website only for lawful purposes and only for the purposes for which it is intended: to learn about the Program, to determine whether you may qualify, and to locate and contact a Service Provider for your own legal needs (or, if you are a Service Provider, to participate in the Program). Without limiting the foregoing, you agree that you will not:
a) use the Directory or any information obtained from it for marketing, solicitation, lead generation, the compilation of mailing lists, or any commercial purpose;
b) access, copy, extract or monitor the Directory or any part of the website by means of any robot, spider, scraper, automated script or other automated means, or reproduce Directory data in bulk;
c) harass, abuse, threaten or defame any Service Provider, JusticeNet staff or volunteer, or other user of the website;
d) impersonate any person, misrepresent your identity or eligibility, or create an account on behalf of anyone other than yourself without authority;
e) guess, test or systematically collect membership numbers, or access another person's registration information without authorization;
f) upload or transmit any virus, malicious code or other material that could damage, interfere with or gain unauthorized access to the website, its servers or any connected network;
g) attempt to gain unauthorized access to any account, portion of the website or system, or circumvent any security or access-control measure;
h) submit any content that is false, misleading, unlawful, defamatory, obscene or infringing of any third party's rights;
i) use the website in any manner that violates applicable law, including privacy, anti-spam and human rights legislation; or
j) use Directory or website information to create a competing directory, a marketing list or a dataset for training automated or artificial-intelligence systems, without JusticeNet's written permission.
User Submissions and Feedback
The website may allow you to submit registrations, enquiries, client feedback, testimonials or other content ("Submissions"). You retain ownership of your Submissions, but you grant JusticeNet a non-exclusive, perpetual, royalty-free, worldwide licence to use, reproduce, edit and publish any feedback or testimonial you submit for the purpose of operating and promoting the Program, provided that JusticeNet will not publish your name or identifying information in connection with a testimonial without your consent. You represent that you have the right to make any Submission and that it does not infringe any third party's rights. JusticeNet may, but is not obliged to, review, edit, decline to publish or remove any Submission in its sole discretion.
Any suggestions or ideas you provide about the website or the Program may be used by JusticeNet without any obligation to you.
Liability
JusticeNet, its employees, directors, volunteers and agents will have no liability for any damage arising from the misuse of any information provided on this website. The information provided on the website is not legal advice and should not be relied upon as such. Doing so without seeking the advice of legal counsel constitutes a misuse of the information.
JusticeNet does not represent or endorse anyone appearing in the Directory. Should a dispute arise between you and any participants listed in the Directory, we cannot intervene. Clients may contact the respective regulatory bodies in order to file a complaint. Moreover, both parties agree to release JusticeNet, its employees, officers, directors, volunteers, successors and assigns from any and all actions, causes of action, claims and demands of every kind and nature arising out of or in any way connected with such a dispute.
Under no circumstances shall JusticeNet or its employees, officers, directors, volunteers, successors or assigns be liable for any direct, indirect, incidental, special, punitive or consequential damages, including loss of data, loss of opportunity, or the loss or impairment of any legal right or claim, that result in any way from your use of or inability to use the information or services provided on this website, from your dealings with any Service Provider, or that result from mistakes, omissions, interruptions, deletions, errors, defects or delays, whether or not JusticeNet has been advised of the possibility of such damages. To the extent that any liability of JusticeNet cannot be excluded, JusticeNet's total liability to you arising out of or in connection with these Terms of Use or your use of the website shall not exceed one hundred Canadian dollars ($100).
Some provinces and territories do not allow the exclusion or limitation of certain warranties, conditions or liabilities, including under consumer protection legislation. Nothing in these Terms of Use excludes or limits any warranty, condition, right or liability that cannot lawfully be excluded or limited, and the exclusions and limitations above apply only to the maximum extent permitted by applicable law.
JusticeNet reserves the right: (a) to modify, suspend, delete or discontinue any or all portions of this website at any time without reason, notice, cost or liability; and (b) to restrict or prohibit access to any users whose use of this website is considered, in its sole discretion, to be abusive, inappropriate, in breach of these Terms of Use or otherwise unlawful.
Indemnification
You agree to indemnify, defend and hold JusticeNet, its employees, officers, directors, volunteers, agents, successors and assigns harmless from and against all claims, losses, expenses, damages and costs, including reasonable legal fees, arising out of or in connection with: (a) your breach of these Terms of Use; (b) any Submission you make; (c) your violation of any law or of the rights of any third party; or (d) any false or misleading information you provide to JusticeNet or to a Service Provider through the website.
Copyright and Trade Marks
The copyright in this website and all materials contained in it is owned, or licensed, by JusticeNet. You are granted a limited, revocable, non-exclusive licence to access the website and to view, download and print pages for your own personal, non-commercial use in connection with the Program, provided that you keep intact all copyright and other proprietary notices. The JusticeNet website (including all data contained in the Directory) may not otherwise be reproduced, published, translated, transmitted, distributed or used to create derivative works, as a whole or in part, for any purpose without the express prior written consent of JusticeNet. Territorial Restrictions and Governing Law
This website can be accessed from Canada and other countries. However, the Program currently serves legal matters in Ontario only. You do not have to live in Ontario to use the website or to seek assistance with an Ontario matter, but the Service Provider you contact must confirm whether they are able to assist with your circumstances and location. JusticeNet makes no representation that the website or its content is appropriate or available for use in connection with matters outside Ontario, and those who access the website from outside Ontario or outside Canada do so on their own initiative and are responsible for compliance with local laws. These terms and conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute arising from the interpretation or application of these terms and conditions will be dealt with exclusively in the courts of Ontario, and you attorn to the jurisdiction of those courts, except that nothing in this section prevents a consumer from bringing a claim in the courts of the province or territory in which they reside where applicable law so requires.
Language

General
These Terms of Use, together with the Privacy Policy and (for Service Providers) the Professionals Terms of Participation, constitute the entire agreement between you and JusticeNet with respect to your use of the website. If any provision of these Terms of Use is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. No failure or delay by JusticeNet in exercising any right operates as a waiver of that right. You may not assign or transfer your rights under these Terms of Use; JusticeNet may assign its rights to any successor organization. The sections concerning Disclaimers, Confidentiality of Communications, Liability, Indemnification, Copyright and Trade Marks, Territorial Restrictions and Governing Law, and this General section survive any termination of your access to the website.
Modifications to Terms of Use
We may change these Terms of Use from time to time. Any changes will be posted on our website at www.justicenet.ca with an updated effective date, and will be made available upon request through your contact at JusticeNet. Where a change is material, JusticeNet will make reasonable efforts to notify registered users by e-mail or by a notice on the website before the change takes effect.
